Man Sues Microsoft (good luck!)

Forget David and Goliath... this will probably be more like Bambi Vs. Godzilla!
Georgia resident Francisco Garcia is suing Microsoft for consumer fraud. Basically because they allowed his underage son to sign up for an Xbox Live account using his dad's debit card and "flouted consumer regulations" when they renewed the service automatically. See, this is why you don't use debit cards for these kinds of things. Because when they charged him the $49.99, it overdrew his account and the bank charged him a $35 fee. As banks do.
Microsoft refunded Garcia the subscription fee, but not the penalty. The company is also looking to have the case dismissed because they claim to have paperwork proving young Silvario Garcia misrepresented his age by stating he was 18 when he signed up. Well, duh, of course he did. You have to be 18. Obviously his dad wasn't about to buy him an Xbox Live subscription, so the kid took matters into his own hands.
You'd think Microsoft would just give the poor guy the 35 bucks instead of however much they're going to spend on legal fees to try and get the case dismissed from federal court. Of course, you'd also think that Mr. Garcia would've kept better watch over his debit card... Oops! Better check that statement and see what else he bought with your money!

I suspect Microsoft doesn't pay anything extra to try to get it dismissed.

Personally I hope Microsoft kicks this guys ass. This whole situation is indicative of exactly the kinds of blame shifting parents constantly do these days. "Is your kid an out of control brat? Don't blame yourself, just blame violent video games!"
Had I pulled a stunt like this my dad would have sent me out to get a job and made me pay him back and I would have learned a little something about personal responsibility. I just find it so frustrating that people feel the need to blame everyone but themselves or their children.
