Romantics Lose To Activision

Well, it was a good try. Remember when The Romantics sued Activision for including their song "What I Like About You" in Guitar Hero: Rocks The 80s? The one-hit wonders insisted that the cover was too accurate, making people believe that they had been involved with and were endorsing the product? (Which I don't get because I doubt they could even buy their way into a VH1 Where Are They Now special) The Romantics were seeking compensation and an injunction to prevent further distribution, but their lawsuit was thrown out by a federal judge.
"Respect for all artists is an important value of the company and Activision has a long history of supporting artists from a range of entertainment fields," the company said in a statement. "The company believes videogames represent a growing opportunity for the music industry to reach new audiences and a strong source of potential license revenue for both bands and music publishers."
So basically, suck it up, Romantics, and be grateful for the money you're getting from having your song included in the first place in a videogame that saved you from slipping further into obscurity.
