'Eli' Sues US Airways For $1 Million Over Lost Xbox

I won't go into the tweedy reasons why I give Yale students/alumns as much guff as I can (GayGamer staff excluded), but let's just say it's something I enjoy tremendously. Perhaps some US Airways baggage handlers felt the same way about 21-year-old Yale student Jesse Maiman, whose expensively-modded Xbox 360 disappeared from his luggage while flying from Connecticut to Ohio.
Despite federal loss limit caps of $3,300 per bag and a policy that excludes liability for electronics, young Mr. Maiman is suing US Airways for anywhere between $25,000 and a million bucks for "non-economic distress," in addition to the reported $1,700 cost of his modded Xbox:
Included in his luggage for that trip was his Xbox 360, which had a specialized hard drive and components he said cost more than $1,000.When he picked up his luggage after landing... he saw that everything was there except the video-game console and its accompanying components... What followed, his suit alleges, was weeks of "an unconscionable 'run-around' "...
"That thing was my DVD player," Maiman, a junior film studies major, said... The suit seeks to have the airline pay him $1,700 for the loss of the gaming system and for "non-economic distress" of at least $25,000, but "in the maximum amount allowable by law or, in the alternative, in the sum of $1,000,000."
While I think most of us here will agree that you don't need to modify an Xbox 360 to use it as your DVD player, you also shouldn't have things stolen from your luggage. Then again, packing your 360 into checked luggage is a bad idea for several reasons, theft being just one.

I'm hoping the airline wins this if it goes to court. It seems like the airline has itself covered between clauses and non-liability for certain checked items.
On the other hand, this will help make sure nothing gets stolen from your luggage when -you- travel US Airways.
