Erik Estavillo Is Back Again, Subpoenaing Bill Gates This Time

In the ongoing saga of Erik Estavillo, the dude who (as you may recall) sued Sony, Nintendo, Microsoft and then Activision Blizzard, a new piece of the story emerges. Not content to sit tight with throwing Winona Ryder on his legal paperwork, Mr. Estavillo has gone ahead and subpoenaed Bill Gates as well.
The subpoena instructs Gates to bring "documents pertaining to the true and relative number of actual Xbox 360 units that have been fixed by Microsoft over the past 3 years." Estavillo is also seeking statistical data showing the true number of Xbox 360s that experienced the RROD (or other break-downs) and data on the actual number of people banned from Xbox Live for "piracy" over the period of 11/28/2008 through 11/28/2009.
While a few other sites have interviewed Mr. Estavillo and asked the big question of "Who will you sue next?," Mr. Dude has promised this is the end of it. He's done! And what's more, he says if he does happen to win anything, he's going to donate half of his judgment to the "Christian Broadcasting Network" and local churches; d'aww.
Joystiq has a lengthy interview with the man himself, giving him time to answer burning questions or tie his own legal noose as it were (the guy is representing himself, after all):
I actually have a five-to-ten page pain and suffering document that I turned in as evidence as my doctors can attest to. My doctors looked at the pain and suffering evidence and realized I was suffering and doubled my [medicine] because of it. So that's pain and suffering, with punitive damages, add those two together, and you get $55,000.
What I want to do is bring national attention to not just [an almost assuredly fake YouTube video of a WoW gamer freaking out after his parents canceled his account] but I wanna bring national attention to how video games are harming ... for instance, I'm not against gaming like Jack Thompson would be, but WoW is actually harmful when they cancel your account. Or when any company cancels your account like Sony canceled mine. It's just harmful to the gamer and I'm trying to bring national attention, hence why I subpoenaed celebrities because they will bring national attention to this.
Erik, let's have a heart to heart: there was a time when I, too, blamed my bad behavior on everyone around me and made up mental illnesses, and then I turned four. Come on now.








Oh he's in for rude awakening if he tries to show that Youtube video. Even the guy who shot the thing admitted it's fake.
I'm not sure about how it works, but doesn't the loser of a legal battle get saddled with the legal costs?
If so, surely this idiot is looking at the business end of a nice bankruptcy.
And the Christian Broadcasting Network thing makes me dislike him even more. Ugh!
No, the loser doesn't have to necessarily pay legal fees. That's part of why people are so litigious in the US; if they followed the model of other countries which holds them responsible for the fees of frivolous lawsuits, maybe less stupidity like this would happen in the future. I think most of the time if the winner wishes to collect on legal fees they'd need to counter sue themselves, but don't quote me.
I havnt checked in on this proper yet, but... Didnt Bill Gates step down from his Microsoft rule? he may have got the wrong guy for the info hes looking for...
Edit: He did in 2000, but remain Chief Software architech or something. still, wrong guy, theres someone else im sure with more qualifing numbers.
